Terms and Conditions
DEFINITIONS:
- The Supplier: Refers to Chairhire.com.au
- The Hirer: Refers to the individual, company, or entity entering into this contract with the Supplier.
- Equipment: Refers to all chairs and associated items hired from the Supplier.
TERMS AND CONDITIONS:
By making a booking with the Supplier, the Hirer enters into a contract and agrees to accept these terms and conditions from the date the booking is confirmed.
1. Payment Terms
The Hirer is liable for all payment. Full payment is required before the event date via Electronic Funds Transfer (EFT) or credit card.
- Credit Card Payments: Incur a 2% surcharge. for VISA and MasterCard only; AMEX incurs a fee of 3%
- Cash Payments: Only accepted on the day of delivery if pre-arranged and confirmed with Chairhire.com.au. If paying by cash, the Hirer or their designated representative must be present at the time of delivery with the correct change. If no one is available to provide cash payment on delivery, we reserve the right not to deliver the Equipment or to charge the credit card provided at the time of booking.
2. Pricing
Chairhire.com.au reserves the right to change prices and specials on our website at any time without prior notice.
3. Security Bond / Credit Card Authorisation
The Supplier requires credit card details or a bond to cover for any damages, theft, cancellations, cleaning, or inability to access the Equipment for agreed pickup. By making a booking, you authorise Chairhire.com.au to charge your provided credit card in the event that any Equipment is lost, stolen, damaged, requires cleaning beyond reasonable use, or if a booking is cancelled according to our cancellation policy, or if Equipment cannot be picked up at the agreed time.
4. Cancellation Policy
- Cancellations outside of 48 hours from the event date will incur a 50% non-refundable cancellation fee of the total booking value.
- Cancellations within 48 hours of the event date will incur a 100% cancellation fee of the total booking value.
- Reductions in Order Quantities: If items are removed from an order or quantities reduced, a cancellation fee will apply to these specific items: 50% for items cancelled outside of a 48-hour period of the event date and 100% for items cancelled within a 48-hour period of the event date.
- COVID-19 Related Cancellations: Cancellations as a direct result of government-mandated COVID-19 restrictions still apply under this policy. However, a credit for 100% of the booking value can be issued if a minimum of 48 hours’ notice is given, valid for 6 months from the original event date.
- By providing your credit card details, you give permission for Chairhire.com.au to charge the card for any applicable cancelled bookings or item reductions.
5. Credit Validity
Any credit applied to a booking, granted by Chairhire.com.au management, must be used by the Hirer within 6 months from the date of the original booking.
6. Extreme Circumstances & Rescheduling
Chairhire.com.au reserves the right to reschedule or cancel a booking if it poses a safety risk to deliver or collect Equipment due to extreme weather conditions (e.g., torrential rains, hail, strong winds, flooding, extreme thunderstorms, earthquake) or if an area is restricted from access due to unforeseen circumstances (e.g., natural disaster, safety alert). Should we be unable to deliver on the original event date due to such reasons, we will endeavour to deliver on the next available day. If the event is entirely cancelled for one of these reasons and cannot be rescheduled, a credit of 50% of the original booking value may be applied for a future booking, valid for 6 months.
7. Hire Period & Overdue Returns
The standard hire period is 1-3 days unless mutually agreed upon in writing by both the Hirer and the Supplier. Failure to make the Equipment available for pickup or inability for our drivers to access the Equipment at the agreed collection time will incur a daily hire charge for the Equipment for any days beyond the agreed hire period. This additional charge may be deducted from any bond, charged to the provided credit card, or invoiced to the Hirer. If the Hirer fails to return the Equipment, the Hirer grants the Supplier permission to enter the premises where the Equipment is held to collect it, without the Supplier being responsible for any damages caused during entry for collection.
8. Hirer’s Responsibility for Equipment
The Hirer accepts full responsibility for the Equipment from the time it is delivered until the time it is collected by the Supplier. This responsibility includes liability for the Equipment even if our driver is delayed for the scheduled pickup. The Hirer is liable for the full replacement cost of any Equipment that is lost, stolen, goes missing, is vandalised, or is broken. The Hirer is also liable for any damages caused to the Equipment, including damages caused by weather conditions or vandalism. In the event that Equipment is excessively soiled or heavily dirtied during the hire period, Chairhire.com.au reserves the right to charge a cleaning fee to restore the Equipment to its original condition.
9. Delivery and Collection Logistics
The Hirer is responsible for having someone available to take delivery of the Equipment at the nominated date and time. If the Hirer fails to be present or arrange for a representative at that time, an additional delivery fee will be charged to re-deliver the Equipment at another time.
- Standard Delivery & Collection Hours: 8:00 AM – 4:00 PM, seven days a week, excluding public holidays.
- Specific Time Delivery: If a specific delivery or collection time is required (outside our standard 4-hour window slots of 8 AM-12 PM or 12 PM-4 PM, which are provided the week of your event), an additional fee may apply.
- Same-Day Collections: May incur an additional fee due to separate driver arrangements.
- Deliveries/Collections Outside Standard Hours (4 PM onwards): May incur an additional fee. Please contact us to discuss.
10. Site Access and Additional Charges
Delivery of all Equipment is at ground level only. Extra charges on top of the usual delivery fee apply where:
- The delivery or collection point for the Equipment is more than 10 meters away from where our vehicle can safely park and unload/load.
- The delivery or collection involves stairs, steep descents/inclines, or going up/down levels within buildings. The Hirer is responsible for informing Chairhire.com.au via email about any such conditions that may affect delivery or collection access prior to the delivery date. Failure to do so will result in extra charges being applied, and in extreme cases, may lead to refusal of delivery if deemed unsafe or unfeasible by our team. Any extra charges incurred will be deducted from the bond, charged to the Hirer’s credit card, or will be payable in cash on the day.
11. Equipment Setup
Chairhire.com.au does not set up the Equipment. All chairs will be carefully placed in a pile or stack at the agreed delivery point for the Hirer to set up at their convenience. If you require setup or pack-down services, this can be offered for an additional hourly rate, but must be pre-booked with our team prior to the delivery date to ensure sufficient time is allocated in our schedule. Instructions for basic setup (e.g., unfolding chairs) can be provided over the phone by calling our office.
12. Equipment Handling and Safety
The Hirer assumes proper knowledge of the operation and handling of the Equipment. The Hirer agrees to follow all relevant Occupational Health & Safety (OH&S) policies and guidelines, and does not hold Chairhire.com.au responsible for any injury caused to themselves or others whilst moving or setting up any Equipment.
13. Ownership and Contract Transfer
The Equipment remains the property of Chairhire.com.au at all times. The Hirer may not transfer this contract or the Equipment to another party without the express written consent of Chairhire.com.au.
14. Inspection Upon Delivery
The Hirer must inspect and check all Equipment upon delivery and notify Chairhire.com.au immediately at the time of delivery if there is any Equipment missing, damaged, or unfit for use. Failure to do so will deem the Hirer responsible for any damages or missing Equipment upon pickup.
15. Warranty and Liability Disclaimers
No warranty is provided by the Supplier for the Equipment’s fitness for any particular use beyond its intended purpose as event seating. Chairhire.com.au takes no responsibility for any damages (e.g., to property, persons) which may be caused by the hire Equipment during the hire period. In the event of adverse weather conditions, we take no responsibility if the Equipment cannot be used as intended due to weather. In the event that weather damages our Equipment during your hire, the Hirer will be responsible for any damages or losses.
16. Marketing Communications
Customers providing email addresses upon booking agree to periodically receive email specials and newsletters from Chairhire.com.au. If you do not wish to receive these, please notify our team when booking.
17. Governing Law
This agreement shall be governed by and construed per the laws of New South Wales (NSW), Australia. The venue for any legal proceedings brought in connection with this contract shall be in NSW.
18. Indemnification
The Hirer agrees to defend, indemnify, assume liability for, and hold Chairhire.com.au harmless from any and all claims, demands, damages, losses, suits, proceedings, penalties, expenses, or other liabilities including attorney fees and court costs, arising out of or resulting from the use of the Equipment by the Hirer or any third party during the hire period, regardless of the basis.
19. Amendments to Terms and Conditions
These terms and conditions can only be amended by Chairhire.com.au. Any changes to this contract must be in writing and signed by both the Hirer and the Supplier to be binding. Oral agreements are non-binding. The latest contract supersedes all previous contracts between the Hirer and the Supplier. This agreement binds and benefits the heirs, successors, and assignees of the parties.
20. Severability
If any court determines that any provision of this agreement is invalid or unenforceable, such invalidity or unenforceability will affect only that specific provision. It will not invalidate or render unenforceable any other provision of this agreement, which shall be modified, amended, or limited only to the extent necessary to render it valid and enforceable.
21. Waiver
If one party waives any term or provision of this agreement at any time, that waiver will only be effective for the specific instance and purpose for which the waiver was given. If either party fails to exercise or delays exercising any of its rights or remedies under this agreement, that party retains the right to enforce that term or provision at a later time.
